These Terms and Conditions govern the access and use of the services and content offered by JJD LATAM SL (hereinafter, the Company) through its websites and applications (collectively, the “Site”). Use of the Site implies full and unreserved acceptance of these Terms.

2. Scope of application
These Terms apply to all offers, orders, purchases, and contracts made through the Site, unless specific conditions are expressly indicated and accepted in writing by the Company.

Consumer/End User: a user acting for purposes outside their commercial or professional activity.

4. Conditions of access and use
Access to the Site is free, except for services expressly offered for a fee. The User agrees to use the Site in accordance with the law, morality, and public order, and not to use it for illegal activities that harm third parties or damage computer systems.
5. Formation of the contract
Offers published on the Site are not binding until the order is confirmed by the Company. The contract shall be deemed perfected when the User receives the order confirmation and/or electronic invoice.
6. Prices and payments
Published prices include applicable VAT, unless otherwise indicated. Payment methods will be specified during the purchase process. The Company will take reasonable measures to ensure the confidentiality of payment data, without prejudice to the security provided by the payment service providers used.
7. Delivery, transport, and deadlines
For physical products, delivery conditions, deadlines, and costs will be detailed in the product sheet and in the purchase process. The Company will report any incident that affects compliance with deadlines and will manage claims according to the shipping and returns policy published on the Site.
8. Right of withdrawal (consumers)
Where applicable (contracts concluded at a distance or off-premises), consumers have the right to withdraw from the contract within 14 calendar days without the need for justification. The exercise of the right of withdrawal and the conditions of return (expenses, procedure, and deadlines) will comply with current regulations and as indicated in the Site’s Return Policy.
9. Guarantees and conformity
The products and services will have the corresponding legal guarantees. In contracts with consumers, the rules of conformity established in the regulations for the defense of consumers and users will apply.
10. Intellectual and industrial property
The contents of the Site (texts, images, brands, logos, databases, software, etc.) are the property of the Company or third parties and are protected by intellectual and industrial property legislation. Reproduction, distribution, or transformation without express authorization is prohibited.
11. Protection of personal data
The Company processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD). The Site will have a Privacy Policy that will inform about purposes, legal basis, retention periods, and rights (access, rectification, deletion, opposition, limitation, and portability), as well as the procedure to exercise them and the data controller. 12. Cookies
The Site will inform the User about the use of cookies and equivalent mechanisms, their purposes, and how to manage or reject them, in accordance with applicable regulations.
13. Responsibility
The Company will not be liable for direct or indirect damages arising from the use of the Site except in cases legally provided for. The Company may suspend, limit, or cancel services when there are indications of misuse or violation of these Terms.

The Site may include links or content from third parties. The Company is not responsible for the content, veracity, or practices of said third parties.
15. Commercial email and communications
The Company may communicate with Users by electronic means for order management, contractual notifications, and commercial communications when the User has given their consent, respecting data protection and electronic communications regulations.
16. Modifications of the Terms
The Company reserves the right to modify these Terms for adaptation to legislative or jurisprudential developments or for changes in services. The modifications will be published on the Site and, where appropriate, notified to Users.
17. Complaints policy and conflict resolution
Consumer Users may submit a complaint to the Company via email hola@noulivin.com. They may also complain to the competent consumer authorities and, where appropriate, use alternative dispute resolution mechanisms.
18. Applicable law and jurisdiction
The relations between the Company and the User shall be governed by Spanish law. For the resolution of disputes, the parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of the consumer’s domicile if the User is a consumer; otherwise, the Court of the Company’s registered address (Madrid) shall have jurisdiction.
19. Sanctions and obligations of the LSSI-CE
Internet service providers must comply with information, conservation, and cooperation obligations provided for in the LSSI-CE; failure to comply may entail administrative sanctions in accordance with applicable regulations.
20. Force majeure
The Company will not be liable for the total or partial breach of obligations when said breach is a consequence of duly justified force majeure causes.
